1. Acceptance of Terms

These Terms & Conditions ("Terms") form a legal agreement between you and Fyzik AI ("FAZIK," "we," "us," or "our") governing your use of the FAZIK mobile application (the "App"). By downloading, installing, or using FAZIK, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree, do not use the App.

2. Description of Service

FAZIK is a fitness application that analyzes a user-submitted photo using AI to estimate physique composition across major muscle groups, and generates personalized workout plans based on that analysis and information you provide during setup. FAZIK also offers workout logging, progress tracking, and gamified streaks/ranks. Certain features require an active FAZIK Pro subscription, described in Section 5.

3. Eligibility

You must be at least 16 years old to use FAZIK. By using the App, you represent that you meet this age requirement and that you have the legal capacity to enter into these Terms. If you are using FAZIK on behalf of a minor between 16 and the age of majority in your jurisdiction, you confirm you have a parent or guardian's permission to do so.

4. Your Data on the Device

FAZIK does not use traditional accounts. Your training data is tied to an anonymous identifier generated on your device, as described in our Privacy Policy. You are responsible for the security of the device FAZIK is installed on, since anyone with access to your unlocked device can access your FAZIK data.

5. Subscriptions & Billing

FAZIK Pro is offered on a subscription basis (Weekly, Monthly, or Annual, with pricing shown in the App and on this site at the time of purchase). By subscribing, you agree that:

• Payment is processed and billed by the Apple App Store or Google Play, depending on your device — FAZIK and its payment partner (RevenueCat) never receive your card details.
• Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the current period ends.
• Your payment method will be charged for renewal within 24 hours prior to the end of the current period, at the then-current price.
• You can manage or cancel your subscription anytime in your Apple ID or Google Play account settings — FAZIK cannot cancel a subscription on your behalf.
• Refunds are handled by Apple or Google under their respective refund policies; we do not process refunds directly.
• We may change subscription pricing going forward; any change will not affect an already-active billing period and, where required by law, we'll notify you in advance of a renewal at a new price.

6. Free Trials

Monthly and Annual plans may include a free trial period, shown in the App at the time of purchase. If you do not cancel before the trial ends, you will automatically be charged for the subscription you selected. Unused portions of a free trial are forfeited if you purchase a subscription during the trial period, where applicable under the store's policy.

7. Health & Fitness Disclaimer

FAZIK's physique scores, body-fat and FFMI estimates, and workout plans are generated by AI models and algorithms for general fitness and informational purposes only. They are not medical advice, a medical device, or a substitute for professional medical or nutritional guidance. Consult a physician before beginning any exercise program, especially if you have a pre-existing medical condition, are pregnant, or are unsure whether an exercise is appropriate for you. You assume all risk associated with physical exercise performed using plans or guidance from the App. FAZIK is not liable for any injury resulting from your use of the App or its workout recommendations.

8. Acceptable Use

You agree not to:

• Use FAZIK for any unlawful purpose or in violation of these Terms
• Attempt to reverse-engineer, decompile, or extract the App's source code or AI models
• Interfere with or disrupt the App's servers or networks
• Upload photos of anyone other than yourself, or any content you don't have the right to submit
• Use automated means (bots, scrapers) to access the App or its backend services
• Attempt to circumvent subscription paywalls or entitlement checks

9. Your Content

You retain ownership of any photo you submit for a physique scan. By submitting a photo, you grant us a limited, non-exclusive license to transmit it to our AI vision provider solely to generate your scan results, as described in our Privacy Policy. We do not store your scan photo on our servers, use it for any purpose beyond generating your results, or use it to train AI models.

10. Intellectual Property

The FAZIK name, logo, app design, and underlying software are the property of Fyzik AI and are protected by intellectual property laws. These Terms do not grant you any right to use our branding except as necessary to use the App as intended. The exercise instructions, illustrations, and video demonstrations in the App's library are licensed for use within FAZIK and may not be extracted or redistributed.

11. Third-Party Services

FAZIK is distributed through, and its subscriptions billed by, the Apple App Store and Google Play — your use of those platforms is also governed by Apple's and Google's own terms of service. Our use of RevenueCat, Cloudflare, and AI vision providers to operate the App is described in our Privacy Policy.

12. Disclaimers

FAZIK IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED PHYSIQUE ANALYSIS WILL BE ACCURATE. YOU USE THE APP AND ANY WORKOUT PLANS AT YOUR OWN RISK.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FYZIK AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, INCLUDING INJURY RELATED TO WORKOUT PLANS OR GUIDANCE PROVIDED BY THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE APP WILL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE 12 MONTHS BEFORE THE CLAIM AROSE. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, SO THEY MAY NOT APPLY TO YOU.

14. Termination

You may stop using FAZIK at any time by deleting the App. We may suspend or terminate your access to the App if we believe, in good faith, that you've violated these Terms. Sections that by their nature should survive termination (including Sections 9, 10, 12, and 13) will continue to apply.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we'll update the "Last updated" date above and, where appropriate, notify you in the App. Continuing to use FAZIK after a change means you accept the updated Terms.

16. Governing Law
